Terms & Conditions

These Terms and Conditions apply to users who are consumers as defined and for purposes of the Consumer Protection Act, 68 of 2008. Your attention is drawn to these Terms and Conditions as they are important and should be carefully noted.

These Terms and Conditions contain provisions which:

  • may limit the risk or liability of the Company or a third party; and/or
  • may create risk or liability for the user; and/or
  • may compel the user to indemnify the Company or a third party; and/or
  • serves as an acknowledgement, by the user, of a fact.

If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask the Company to explain it to you before you accept the Terms and Conditions or continue using the Website.

Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or the Company in terms of the CPA.

The Company permits the use of this Website subject to the Terms and Conditions. By using this Website in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally. You must not use this Website if you do not agree to the Terms and Conditions.

1.1. Confirmation of Sale

The quotation, pro forma or Tax Invoice and cross-referenced documentation, together with the Customer’s acceptance of these Standard Terms and Conditions are the sole documents covering the transaction between the parties.

The Customer and RE Solutions specifically agree that ownership of the goods hereby sold or assembled shall vest in RE Solutions until the full amount as per the relevant quotation, pro forma or tax invoice, together with all interest and any additional costs of whatsoever nature, is paid in full and until such full payment has been made, RE Solutions retains the right to at any stage collect and remove the goods from the Customer, after obtaining the necessary court order.

1.2. Phone Call/Communications

All inbound and outbound calls will be recorded for quality and training purposes, improve the customer experience, boost agent productivity, evaluate agent performance, resolve disputes.

1.3. Price Changes

Prices are subject to change without prior notice as and when required and are usually linked to changes in the Rand Dollar exchange rate.

1.4. Cancelation of an Order

We reserve the right to cancel any special or order without notice. This is regardless of any communication from RE Solutions stating that your order or payment has been confirmed, you will receive an email, call, or SMS if the order was cancelled and as soon as possible thereafter, refunding you for the amount paid.

1.5. In Stock

Occasionally items that show in stock may be out of stock. We reserve the right to cancel any order without notice. All quotations or orders are valid for 24 hours or until stock lasts. The stock is sold on a first come first serve basis. Payment for any order must be made upfront and must reflect in our account before we process the order.

1.6. Banking Details and Payments

Payment of the amount reflected on the invoice is to be paid into the designated account and within the prescribed period as set out in the invoice and it is recorded that the invoice and all documents referred to in this agreement form part of the Standard Terms and Conditions.

In the event of RE Solutions for whatsoever reason allowing late payment then such late payment will attract interest at 2% above the prime interest rate per month charged by RE Solution’s bankers.

In the event of the Customer not adhering to the payment terms as stipulated, RE Solutions retains the right to; without prejudice to any other rights or remedies afforded to it by law:

  • To provide the client with a formal letter of demand
  • Claim specific performance and enforce the provisions of this agreement; or
  • Cancel the agreement and claim from the Customer any damages resulting from non-compliance with the terms hereof

It is recorded that in arriving at the price as set out in the invoice that certain discount concessions were made on the grounds that payment would be affected as per the invoice. In the event of payment not being made in terms of the invoice, then all such discounts as allowed for by RE Solutions will be cancelled and added to the total sum outstanding.

In the event of

  • The Customer defaulting in its obligation to make payment on the due date; or
  • The Customer is unable to receive the goods on the delivery date;

then The Customer agrees to pay RE Solutions such costs as RE Solutions may have incurred in the storage or freighting of the goods. It is recorded that the terms of this clause do not create an obligation on RE Solutions to store such goods. The Customer is to accept all risks of damage caused during transport to and from storage to the Customer designated/appointed delivery address. The Customer is advised to insure the goods while in delivery.

No latitude or extension of time which may be allowed by RE Solutions to the Customer in respect of any payment provided for herein or any other matter or thing which the Customer is bound to perform or observe in terms hereof shall be deemed to be regarded as a waiver of any of RE Solution’s rights under the law.

If you have received an email, WhatsApp or a call to tell you we have changed our banking detail, please contact us immediately to provide confirmation in writing on our official company letterhead.

The following payment methods are acceptable to RE Solutions:

  • Electronic Funds Transfer (EFT) or Bank Deposits, No Cheque deposits.
  • Vista/ Master Card
  • PayFast

IMPORTANT! All orders placed after 15:00 (*Business Hours only) will only be processed the following business day.

1.7. Shipment Method

Whilst delivery times are given in good faith and RE Solutions will use every endeavour to comply therewith, no responsibility can be accepted for any loss or damage incurred by the Customer on account of any delay in delivery arising out of any circumstances beyond RE Solution’s control, which circumstances will include, but in no way be limited to:

  • any delays in the supply of goods by RE Solution’s suppliers which cannot be directly or indirectly attributed to them;
  • If the balance of the purchase price payable on delivery is not payable on the date of anticipated delivery RE Solutions will communicate an unavoidable delay in delivery.

Payment for any order must be made upfront and must reflect in our account before we process the order.

All equipment is shipped directly from our supplier warehouse to the shipping address provided in your order form.

Due to lockdown and restrictions, we have digitally transformed our business into an Online only store. If a customer opts to collect or arrange alternative shipping arrangements, items can be collected directly from our suppliers in the timeslot provided considering necessary COVID protocols.

Please confirm if your selected item is available for same-day collection at supplier warehouses as not all warehouses allow end-user collections or have a limit on the number of customer collections per day.

1.8. Delivery charges

Refer to the Delivery information section for guidelines on delivery charges.

Orders placed on weekends or public holidays are processed the following business day.

General Delivery Info

We do not deliver to Postal Boxes as our service includes delivery via Courier (Door to Door). Deliveries are made during business hours 08h00-17h00 Mon-Fri excluding public holidays. Our couriers don’t give exact delivery times and will deliver between 8 am and 5 pm, Monday to Friday.

Our couriers require someone to be at the address provided to accept the delivery alternatively the goods will be returned.

Should no one accept the delivery the first time around, a second delivery attempt will be arranged, additional charges may apply.

We reserve the right to change the shipping method from delivery to collection due to the weight of items.

Additional surcharges can apply on heavy deliveries.

Orders are processed from when the payment is received and reflects in our bank account (business hours).

1.9. International Orders

We do not deliver outside the borders of South Africa, but you may arrange for a courier service to collect from us once an arrangement has been made.

Applicable to international customers only: RE Solutions is not a registered exporter and therefore do not deliver goods outside the borders of South Africa. All invoices will be in South African Rands.

1.10. Product Returns

RE Solutions does not sell products on a trial basis. Customers are strongly advised to check the suitability and specifications of products before placing orders.

No goods can be returned after 7 days or will be taken back if opened. It must be in its original packaging, undamaged and unused, with the original labels still attached.

It may take 7 to 14 business days for your financial institution to process the funds back into your account.

If an incorrect product is delivered to you by mistake (i.e., it is not the product you ordered), we will arrange to collect the product from you, and we will deliver the correct product to you as quickly as possible.

Please don’t remove the product from its original packaging. Simply contact our customer service on email info@re-solutions.online to notify us, and we will take care of the rest.

1.11. Dead on Arrival (DOA)

If your products have been damaged en-route or if they are DOA, Please contact us immediately so that we can arrange for the collection of the goods. It is your responsibility to thoroughly check the products and advise us if you feel there is any fault or damage. FAULTY OR DAMAGED GOODS MUST BE DECLARED WITHIN 48-HOURS. As soon as we receive the item and it has been tested to confirm the fault, the product will either be repaired and returned, or a replacement will be sent (dependent on the manufacturer’s policy).

The Supplier / RE Solutions reserves the right to charge a handling/re-stocking fee of up to 50% on open/new items returned.

1.12. Returns

RE Solutions agreements with its suppliers with regards to returns in terms of Section 55 of the CPA shall apply mutatis mutandis to THE CLIENT, having the effect such that the terms apply directly between THE CLIENT and the supplier of the product that THE CLIENT wishes to return. RE Solutions will merely act as an intermediately between THE CLIENT and the supplier. Returns of items with damage to any barcode, serial number or identification number will not be accepted. All costs relating to the return of items, including but not limited to courier cost, shall be payable by THE CLIENT. RE Solutions may charge a handling fee on returns. All risk of damage, theft or loss of the items being returned shall rest with THE CLIENT.

1.13. Cooling-off Period

THE CLIENT shall not be entitled to the cooling-off provisions as contained in section 44 of the ECT Act since THE CLIENT requests a formal quotation prior to making the purchase. All orders are made to the specifications of THE CLIENT.

1.14. Ordering Process

1.15. Warranty

All warranties are covered by the manufacturers themselves and dealt with in the same way as if this item is purchased from an authorized retail outlet. No Warranty from damage from natural disasters, No Warranty if the serial number label is missing, damaged or tampered with.

All warranties are with the manufacture‚ and or/ distributors of the products and are not with RE Solutions.

All goods sold by RE Solutions carry a minimum of a 1-year carry-in warranty with the manufacturer.

Should a product or device not be subject to an additional warranty by RE Solutions and only a manufacturer warranty, RE Solutions may assist in the returns/repair process, however, shall not be obligated to do so.

Customers who wish to make a warranty claim must comply with the manufacturer instructions and warranty procedures.

Software is under no circumstances covered by any warranty on any product. This includes but is not limited to software faults/errors or data loss.

1.16. Limitation of liability

RE Solutions cannot be held liable for any inaccurate information published on the Website and/or any incorrect prices displayed on the Website, save where such liability arises from the gross negligence or willful misconduct of RE Solutions, its employees, agents or authorized representatives. You are encouraged to contact us to report any possible malfunctions or errors.

RE SOLUTIONS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS OR DAMAGES WHICH MIGHT ARISE FROM YOUR USE OF, OR RELIANCE UPON, THE WEBSITE OR THE CONTENT CONTAINED IN THE WEBSITE; OR YOUR INABILITY TO USE THE WEBSITE, AND/OR UNLAWFUL ACTIVITY ON THE WEBSITE AND/OR ANY LINKED THIRD PARTY WEBSITE.

YOU HEREBY INDEMNIFY RE SOLUTIONS AGAINST ANY LOSS, CLAIM OR DAMAGE WHICH MAY BE SUFFERED BY YOURSELF OR SUPPLIER ARISING IN ANY WAY FROM YOUR USE OF THIS WEBSITE AND/OR PRODUCTS SOLD.

YOU HEREBY INDEMNIFY RE SOLUTIONS AGAINST ANY LOSS, CLAIM OR DAMAGE WHICH MAY BE SUFFERED BY YOURSELF OR SUPPLIER ARISING IN A WARRANTY CLAIM.

2. General

The Customer acknowledges the risks involved in providing Electrical Equipment/related goods and hereby indemnifies RE Solutions against claims for harm/damage caused to person/property due to reasons beyond the reasonable control or unintentional act of any person, whether or not in the employ of RE Solutions. This will include any economical loss pertaining to the harm/loss caused.

The terms of the agreement between the Customer and RE Solutions are set out in this agreement and the documents referred and no alterations or amendments of the terms and conditions will be binding on the parties unless same is reduced to writing.

RE Solutions and the Customer hereby consent to the jurisdiction of the Magistrates Court in respect of every legal proceeding which may emanate from any breach of any of the terms and/or conditions of this agreement. The Customer agrees that in the event of RE Solutions instituting legal proceedings, that the Customer will be liable for all costs on a scale inclusive of collection commission as determined by the Court of Law or tribunal where the collection matter will be adjudicated and interest at 2% per month as charged from time to time.
